President Obama Moves for Change to Visa Law

January 17, 2012 – A piece of good news has come from the Obama administration. Last Friday, it announced that it is going to make a proposal to fix a catch-22 immigration law. This means that American citizens will no longer have to suffer separation from their immigrant spouses and children. This means it may not anymore be as difficult to get a US visa anymore.

This was seen by many lawyers to be very positive as separation will no longer be a problem for citizens. They can also be freer to bring forward their illegal immigrant relatives in order to gain an American visa or get a USA visa application.

Immigrant lawyers, immigrants, and Latino groups praised the said news. The latter is the group that has the highest deportation rate under the Obama administration.

“This will open up a huge door to bring a large number of people into the light,” said Charles Kuck. Kuck is an immigration lawyer and former president of the American Immigration Lawyers Association.

This particular move was labeled as a “welcome rational solution to a simple problem” according to Angelica Salas, Coalition for Humane Immigrant Rights in Los Angeles Executive Director. She added that this means “thousands upon thousands of families will remain together.”

This move is among the strategies of White House officials to raise the lowering support for President Obama. It can be noted that it is among the measures of the administration that does not need Congress approval.

With this approved, immigrant spouses and children, including those who illegally entered the US, may already be applied a green card by US citizens. However, they will need to receive their United States visa in their home country. This means that they will have to go home first.

Under the law, these immigrants will be barred from entering the US again for at least 3 years once they leave the country. But if they can prove that their absence would mean “extreme hardship” for a US citizen, a waiver from being barred may be issued. However, this process is also very difficult. People who applied for such waiver had to wait for years in their home country.
