Before traveling to the U.S., all citizens of a foreign country are generally required to obtain a nonimmigrant USA visa for temporary stay or an immigrant visa for permanent residence. The type of visa required is based on the purpose of travel.

H2B Cap Count FY 2012. The cap amount for the FY 2012 is 66,000, of which as of February 10, 2012, USCIS has received filings on behalf of approximately 34,481 beneficiaries, and approved approximately, 26,257 H2B beneficiaries.

Transportation Worker Identification Credential (TWIC) – Visa Annotations. As of February 1, 2011, the Departments of State and Homeland Security had introduced an annotated version of the B-1 visa. This was issued to foreign citizens visiting the United States for business purposes making foreign maritime workers eligible to apply for a Transportation Worker Identification Credential (TWIC). Now, maritime workers who will perform services in secure port areas must have their visas annotated “TWIC Letter Received” in order to gain unrestricted access to secure areas of U.S. maritime facilities.

EB-2 Priority Dates for India and China reach May 1, 2010. According to U.S. Department of State Visa Bulletin for March 2012, the EB-2 priority dates for India and China have been moved to May 01,2010 from January 01, 2010 in the February 2012 Visa Bulletin. Meanwhile, the EB-2 numbers for other countries still remained current, along with EB-1, EB-4, and EB-5 numbers for all countries.

L Visas to be issued for up to 5 years. A new rule was passed that delinks visa and petition validity periods, and allows the issuance of L visas with validity periods based on the visa reciprocity schedule, which for certain countries, can be for a period up to 5 years. L-1 beneficiaries who are nationals of countries for which the reciprocity schedule prescribes visa validity for a longer period of time than the initial validity indicated in their approved L-1 petition and who have extended their stay on L-1 status while in the United States would benefit from this change. However, take note that this change affects only the validity period of the L-1 visa, and does not alter the period of time that an L-1 nonimmigrant can stay in the United States.
